Midway Vacations Social Media Contest Terms and Conditions

Thank you for participating in the Midway Vacations Social Media Contest. By entering this contest, you agree to abide by the following terms and conditions:
Eligibility:
All entrants must be twenty-one (21) years of age or older and have online access as of the date of entry into the Giveaway. Employees of Midway Vacations (“Sponsor”) or any affiliate – those involved in the production, development, implementation, or handling of the Giveaway, including and without limitation, any agents acting for, or on behalf of the above personas or entities, their respective parent companies, or any other person or entity associated with the Giveaway are ineligible to enter this Giveaway. Immediate family members (i.e., a spouse, domestic partner, child, sibling, or parent) and/or any person, whether related or not, living in the same household of an individual affiliated with the Giveaway are also ineligible to enter this Giveaway.NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS GIVEAWAY. PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited by law. Subject to all federal, state, and local laws.
How to Enter:
Follow the entry instructions provided in the contest announcement on Midway Vacations’ official social media channels. Ensure your entry complies with any content requirements specified in the contest guidelines.
Odds of winning the prize depend on the total number of eligible entries received during the entire Giveaway Period.
You must have a public Instagram account and, if you are selected as a winner, must be able to receive Direct Messages
Entry Deadline:
Entries must be submitted February 8th, 2024 at 11:59 PM HST. Late entries will not be considered.
The Prize includes 2 night stay at the Waikiki Banyan Condo hosted by Midway Realty LLC, dba Midway Vacations.
Winner Selection:
Winners will be selected through a random drawing or as otherwise specified in the giveaway promotion. The decision of the organizers is final.
Winner Notification And Announcement:
Winners will be notified via direct electronic communication, i.e.: Instagram or Facebook messenger and/or email, within 7 days of Contest/Giveaway Entry Deadline.
Winners must respond within 48 hours of Notification. If the Winner fails to respond or reply to direct message within the required time period, or any prize/prize notification is returned undeliverable, or in the event that the potential winner is disqualified for any reason, Midway Realty LLC, dba Midway Vacations, will award the prize to an alternate winner selected by a random drawing from among all remaining eligible entries received throughout the Giveaway Period. The prize will be awarded provided a sufficient number of eligible entries are received throughout the Giveaway Period.
If you are selected as a winner, we may publicly announce your name (or username) on our social media channels and website. This is to celebrate and acknowledge your victory.
Winner and winner’s guest will be required to have/present at least one (1) major credit card or debit card in good standing or make a cash deposit upon check-in to Midway Realty LLC, dba Midway Vacations. Winner and guests must follow any applicable COVID protocols at time of travel in order to use prize. Winner’s guests (or winner on behalf of minor guest who is winner’s child/charge) must complete a release of liability prior to use of prize.

Prize Fulfillment:
Prizes are non-transferable and cannot be exchanged for cash. Midway Vacations reserves the right to substitute a prize of equal or greater value in the event the
advertised prize is unavailable.
Prize subject to availability and Blackout Dates; December 24th – January 3rd. Prize must be redeemed within 1 year of Award Date.
Publicity:
By participating, you grant Midway Vacations the right to use your name, likeness, and submitted content for promotional purposes related to the contest.
EXCEPT WHERE PROHIBITED BY LAW, WINNER GRANTS TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR AND/OR ITS AGENTS), AND THOSE ACTING PURSUANT TO THEIR AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, ENTRY, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. ENTRANTS AGREE THAT SPONSOR SHALL OWN THE ENTRIES, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED, AND THAT SPONSOR AND ITS DESIGNEES SHALL HAVE THE PERPETUAL, WORLDWIDE RIGHT TO EDIT, PUBLISH, AND USE THE ENTRIES IN ANY WAY AND IN ANY MEDIA FOR TRADE, ADVERTISING, PROMOTIONAL, AND/OR OTHER PURPOSES AS SPONSOR AND/OR ITS DESIGNEES MAY DETERMINE WITHOUT FURTHER CONSIDERATION TO ENTRANTS OR ANY THIRD PARTY.
Disqualification:
Midway Vacations reserves the right to disqualify entries that do not comply with the contest rules or that are deemed inappropriate.
Any attempt to manipulate or tamper with the contest may result in disqualification.
Potential winner is subject to verification by Sponsor and/or Administrator, whose decisions are final and BINDING IN ALL MATTERS RELATED TO THE GIVEAWAY. An entrant is not a winner of the prize unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete.
Release of Liability:
By participating in the Giveaway you acknowledge and agree to the following release of liability terms:, each entrant agrees (a) to abide by these Official Rules, and that all decisions of Sponsor shall be final and binding in all respects relating to this Giveaway; (b) to release, discharge and hold harmless Sponsor, and their respective affiliates, subsidiaries, and advertising and promotion agencies and their respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively “Released Parties”) from any and all liability for any and all injury, losses and damages of any kind to any persons or property, including death, and resulting in whole or in part, directly or indirectly from participating in the Giveaway or any related activity or the acceptance, possession, use or misuse of the awarded prize.
The organizers of this giveaway (hereinafter referred to as “the Organizers”) assume no responsibility or liability for any damages, losses, or injuries resulting from your participation in the giveaway, including but not limited to the use of any prizes awarded.
Privacy:
Participant information will be handled in accordance with the Midway Vacations Social Media Contest Privacy Policy.
Modification or Termination:
Midway Vacations reserves the right to modify or terminate the contest at any time for any reason. The Organizers reserve the right to modify these limited liability terms at any time. Participants are encouraged to review these terms periodically for changes.
By participating in the giveaway, you acknowledge that you have read, understood, and agreed to these limited liability terms. If you do not agree to these terms, please do not participate in the giveaway.
Governing Law:
These terms and conditions are governed by the laws of the United States Government and the State of Hawaii,, and any disputes will be resolved in the appropriate courts. This giveaway is subject to applicable federal, state, and local laws and regulations.
This giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram and Facebook. You understand that you are providing your information to Midway Vacations and not to Instagram. The information you provide will only be used in the event you are selected as a winner.
DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Hawaii or the appropriate State Court located in Hawaii; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Hawaii, without giving effect to any choice of law or conflict of law rules (whether of the State of Hawaii or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Hawaii.
